Common Questions About Workers' Compensation

Are you uncertain about what benefits may be available to you? Minnesota workers’ compensation law is one of the most complex in the nation. Here are some frequently asked questions.

What Should I Do First If I Am Injured On The Job?

Seek medical attention. Report your injury to your supervisor or your employer as soon as possible. Make sure your employer fills out a First Report of Injury form. If the employer refuses, contact St. Paul workers’ compensation Attorney Gregg B. Nelson at 651-483-1520. Gregg has been helping clients win their workers' compensation claims for more than 30 years. He will fight to help you receive the benefits you deserve.

The Insurance Company Wants Me To Attend An Independent Medical Examination (IME). What Is An IME? Do I Have To Attend?

An IME is an examination by a medical care provider chosen by the insurance company. Under Minnesota workers' compensation law, you are required to attend the examination. Your workers’ compensation benefits may be suspended if you fail to attend. The doctor hired by the insurer is not your friend and does not intend to help you with your injury. Gregg Nelson can advise you further about this process.

Should I Hire An Attorney If I Am Injured On The Job?

Minnesota workers’ compensation law is complex. Mistakes in navigating the system can cost you income, medical care, and even your job. GBN Law can help. St. Paul Workers' Compensation Lawyer Gregg Nelson has been helping clients win their workers' compensation claims for more than 30 years. Gregg is also a former insurance lawyer; he knows the tricks insurers use. Gregg will help you navigate the pitfalls in workers' compensation laws that favor employers and insurers. He will fight to help you get full and fair compensation for all of your losses, from wages or income to medical expenses, vocational rehabilitation, and benefits for permanent loss of function.

Will I Be Fired If I File A Workers’ Compensation Claim?

Termination in retaliation for seeking benefits is illegal. If you are fired following filing a claim for benefits, contact Gregg Nelson at GBN Law at 651-483-1520. A separate lawsuit can be filed relative to retaliatory terminations or other illegal conduct if the necessary facts are present.

What Should I Do If The Insurance Company Denies Payment Of Medical Bills Or Won’t Approve The Treatment Recommended By My Doctor(s)?

Contact Gregg Nelson at GBN Law at 651-483-1520. The Department of Labor and Industry (DLI) must certify that a dispute exists before further action. Gregg can prepare and file a request for certification, then file a claim to get the bills paid or the care approved.

I Was Injured On The Job, And My Employer Doesn’t Have Workers’ Compensation Insurance. What Should I Do?

Contact GBN Law at 651-483-1520. St. Paul workers’ compensation Lawyer Gregg B. Nelson has represented many employees injured while working for uninsured employers. Sometimes, an employer will claim that an injured employee is an “independent contractor.” This is usually not true and is simply used as a way to avoid responsibility. Gregg will help you file a First Report of Injury and help you confirm whether your employer was insured for workers' compensation liability. If your employer is not insured, the state will pay your claim.

Can I Afford To Hire A Workers’ Compensation Lawyer?

Yes. Schedule a free consultation with Gregg B. Nelson at GBN Law by calling 651-483-1520. If you retain GBN Law, the attorney fee is statutory and contingent. You pay nothing unless you win your claim.
